1. AGREEMENT TO TERMS
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and One Habit ("we," "us," or "our") regarding your use of the One Habit mobile application (the "App").
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.
This agreement is between you and One Habit only, and not with Apple Inc. ("Apple"). One Habit, not Apple, is solely responsible for the App and its content.
2. ACCEPTANCE AND ELIGIBILITY
2.1 Age Requirement
You must be at least 18 years old to use this App. By using the App, you represent and warrant that you are 18 years of age or older.
2.2 Account Creation
To use certain features of the App, you must create an account. You agree to:
Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Maintain the security of your account credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use
3. LICENSE GRANT AND RESTRICTIONS
3.1 Limited License
Subject to your compliance with these Terms, One Habit grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use.
3.2 License Restrictions
You may NOT:
Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove, alter, or obscure any proprietary notices
Use the App for any commercial purpose
Transfer, sublicense, rent, lease, or lend the App
Use the App on any device you do not own or control
Use the App to violate any applicable laws or regulations
Attempt to gain unauthorized access to any part of the App
Interfere with or disrupt the App's operation
Use automated systems to access the App without permission
3.3 Device Compatibility
This license is limited to use on Apple-branded products running iOS that you own or control, as permitted by the Apple Media Services Terms and Conditions.
4. HOW ONE HABIT WORKS
4.1 Habit Commitment
One Habit is a financial accountability-based habit tracking application. Users commit to completing a single habit on a defined schedule (daily, weekly, or custom frequency) and set a commitment fee amount that will be charged if they fail to complete the habit as committed.
4.2 Financial Accountability Mechanism
You authorize One Habit to charge the commitment fee amount you specify to your payment method when you fail to complete your committed habit
Commitment fees are service fees paid to One Habit for providing the accountability mechanism
One Habit separately donates a portion of company proceeds to charitable organizations
Once a commitment fee is triggered, the transaction cannot be reversed except as required by law or our refund policy
4.3 Check-In Requirement
You must check in via the App to confirm completion of your habit within the timeframe you specified during setup. Failure to check in by the deadline will be considered a missed habit and will trigger the commitment fee charge.
5. SUBSCRIPTION AND PAYMENT TERMS
5.1 Subscription Service
One Habit is a subscription-based service. To use the App, you must maintain an active subscription. Subscription fees are charged monthly and provide access to all App features, including the ability to create and track habit commitments.
5.2 Commitment Fee Authorization
By setting up a habit with a commitment fee, you authorize One Habit to charge your designated payment method for:
Your monthly subscription fee
Commitment fee amounts when you fail to complete your committed habit
Any applicable transaction or processing fees
5.3 Payment Processing
Payments are processed through Stripe, Inc. ("Stripe"), a third-party payment processor. By using the App, you agree to Stripe's Services Agreement and Privacy Policy. One Habit does not store your complete payment card information.
5.4 Payment Method Requirements
You must provide a valid payment method to create a subscription and habit commitment. You represent and warrant that:
You are authorized to use the payment method provided
The information you provide is accurate and current
You will maintain sufficient funds or credit to cover subscription and commitment fee charges
5.5 Failed Payments
If a subscription or commitment fee charge fails due to insufficient funds, expired card, or other payment issues:
You remain obligated to pay the amount owed
We may suspend your account and ability to use the App
We may attempt to process the payment again
5.6 Subscription Cancellation
You may cancel your subscription at any time through the App settings or by contacting customer support. Upon cancellation:
You will retain access to the App through the end of your current billing period
Your subscription will not renew for the next billing period
Outstanding commitment fee obligations remain enforceable
You will not receive a refund for any unused portion of your subscription period
5.7 No Refund Policy for Commitment Fees
All commitment fee charges are final and non-refundable. By using the App, you acknowledge that:
Commitment fees are triggered automatically based on your check-in status
You are solely responsible for checking in on time
Technical difficulties on your end do not constitute grounds for refund
One Habit is not responsible for missed check-ins due to device issues, internet connectivity, or user error
Exceptions may be made only in cases of:
Verified technical failures on One Habit's end that prevented check-in
Unauthorized payment processing due to account compromise
As required by applicable law
5.8 Subscription Refund Policy
Subscription fees are generally non-refundable. However, we may issue refunds at our sole discretion for:
Unused subscription time if you cancel within 48 hours of initial purchase
Billing errors or duplicate charges
As required by applicable law
5.9 Charitable Giving
One Habit donates a portion of company proceeds to reputable charitable organizations. Users do not make direct charitable donations through the App. Information about One Habit's charitable giving will be available on our website.
6. USER RESPONSIBILITIES
6.1 Accurate Information
You are responsible for:
Setting realistic and achievable habit goals
Selecting appropriate commitment fee amounts
Ensuring timely check-ins
Maintaining accurate payment information
Understanding timezone settings and check-in deadlines
6.2 Prohibited Conduct
You agree NOT to:
Use the App for any unlawful purpose
Harass, abuse, or harm other users
Submit false or misleading information
Attempt to manipulate the check-in system
Use the App in any way that could damage, disable, or impair the service
Violate any third-party rights
7. INTELLECTUAL PROPERTY
7.1 Ownership
One Habit retains all rights, title, and interest in and to the App, including all intellectual property rights. This includes but is not limited to:
The App's design, code, and functionality
One Habit trademarks, logos, and branding
All content, features, and functionality
Any updates, modifications, or enhancements
7.2 User Content
You retain ownership of any personal information or content you submit to the App. By using the App, you grant One Habit a limited license to use, store, and process this information solely to provide the service.
7.3 Feedback
If you provide feedback, suggestions, or ideas about the App, you grant One Habit an unlimited, irrevocable, perpetual, royalty-free license to use such feedback without compensation or attribution.
8. THIRD-PARTY SERVICES AND LINKS
8.1 Third-Party Terms
Your use of the App may require compliance with third-party terms of service, including but not limited to:
Apple Media Services Terms and Conditions
Stripe Services Agreement
Your wireless carrier's data service agreement
Any other third-party services integrated with the App
8.2 External Services
The App may provide access to or integrate with third-party services, websites, or content ("External Services"). You agree to use External Services at your sole risk. One Habit:
Does not control or endorse External Services
Is not responsible for the content, accuracy, or practices of External Services
Makes no warranties regarding External Services
Is not liable for any damages arising from your use of External Services
8.3 Apple-Specific Terms
You acknowledge and agree that:
These Terms are between you and One Habit only, not Apple
Apple has no obligation to provide maintenance or support for the App
Apple is not responsible for addressing any claims related to the App
Apple is not responsible for investigating, defending, or settling third-party claims related to the App
Apple is a third-party beneficiary of these Terms and may enforce these Terms against you
9. PRIVACY AND DATA
9.1 Privacy Policy

9.2 Data Collection
One Habit collects and processes data necessary to provide the service, including:

Payment information (processed through Stripe)
Device and usage information
Communication preferences and settings
9.3 Account Deletion
You may request deletion of your account at any time through the App settings. Upon deletion:
Your account will be deactivated
Personal information will be deleted in accordance with our Privacy Policy and legal retention requirements
Outstanding subscription and commitment fee obligations remain enforceable
Some information may be retained for legal, security, or business purposes as described in our Privacy Policy
10. DISCLAIMERS AND WARRANTIES
10.1 No Medical or Professional Advice
THE APP IS NOT INTENDED TO PROVIDE MEDICAL, PSYCHOLOGICAL, FINANCIAL, OR PROFESSIONAL ADVICE. The App is a habit tracking tool only. You should consult qualified professionals for advice specific to your situation.
10.2 Behavioral Change Not Guaranteed
ONE HABIT DOES NOT GUARANTEE THAT USE OF THE APP WILL RESULT IN HABIT FORMATION, BEHAVIOR CHANGE, OR ACHIEVEMENT OF YOUR GOALS. Results vary based on individual effort and circumstances.
10.3 "AS IS" Provision
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Implied warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy, reliability, or completeness
Uninterrupted or error-free operation
Freedom from viruses or harmful components
10.4 Apple Disclaimer
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPLE WILL HAVE NO OTHER WARRANTY OBLIGATION WHATSOEVER WITH RESPECT TO THE APP.
11. LIMITATION OF LIABILITY
11.1 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONE HABIT SHALL NOT BE LIABLE FOR:
Indirect, incidental, special, consequential, or punitive damages
Lost profits, revenue, data, or business opportunities
Costs of substitute services
Damages arising from your use or inability to use the App
Damages resulting from missed check-ins or commitment fee charges
Any damages exceeding the amount you paid to One Habit in the 12 months preceding the claim
11.2 Your Sole Remedy
Your sole and exclusive remedy for dissatisfaction with the App is to stop using it, cancel your subscription, and delete your account.
11.3 Apple's Limited Liability
Apple shall not be liable for any claims related to the App, your possession or use of the App, or any third-party claims.
11.4 Basis of the Bargain
You acknowledge that One Habit has offered the App, set its prices, and entered into these Terms in reliance upon the disclaimers and limitations of liability set forth herein, and that they form an essential basis of the bargain between you and One Habit.
12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless One Habit, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Any content you submit to the App
Your failure to pay subscription or commitment fee amounts when due
13. PRODUCT CLAIMS AND INTELLECTUAL PROPERTY
13.1 Product Claims
You acknowledge that One Habit, not Apple, is responsible for addressing any claims relating to the App or your use of it, including:
Product liability claims
Claims that the App fails to conform to legal or regulatory requirements
Claims under consumer protection, privacy, or similar legislation
13.2 Intellectual Property Infringement
In the event of any third-party claim that the App or your use of the App infringes that third party's intellectual property rights, One Habit, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim to the extent required by these Terms.
14. MODIFICATIONS AND TERMINATION
14.1 Changes to Terms
One Habit reserves the right to modify these Terms at any time. Changes will be effective upon posting to the App or website. Continued use of the App after changes constitutes acceptance of the modified Terms. Material changes will be communicated via email or in-app notification.
14.2 Changes to the App
One Habit may:
Modify or discontinue any feature of the App
Change subscription pricing or commitment fee structures
Remove the App from distribution
Suspend or terminate the service
We will provide reasonable notice of material changes when practical.
14.3 Your Right to Terminate
You may terminate your account and subscription at any time by:
Using the cancellation feature in the App settings
Contacting customer support at [email protected]
Termination stops future subscription charges but does not waive outstanding commitment fees or other amounts owed. Outstanding obligations must be paid before creating a new account.
14.4 Our Right to Terminate
We may suspend or terminate your account immediately if you:
Violate these Terms
Engage in fraudulent or illegal activity
Abuse the service or other users
Fail to pay amounts owed
Engage in conduct that damages One Habit's reputation or business
14.5 Effect of Termination
Upon termination:
Your license to use the App immediately ends
You must cease all use of the App
Your subscription will be cancelled (subject to our refund policy)
Sections of these Terms that by their nature should survive will survive
Outstanding payment obligations remain enforceable
15. DISPUTE RESOLUTION
15.1 Informal Resolution
Before filing a claim, you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith within 30 days.
15.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of California, USA, without regard to conflict of law principles.
15.3 Arbitration Agreement
Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except as otherwise provided herein. You waive your right to participate in class action lawsuits or class-wide arbitration.
15.4 Exceptions to Arbitration
Either party may bring a claim in small claims court if it qualifies. Either party may seek injunctive relief in court to prevent infringement of intellectual property rights.
15.5 Venue
If arbitration does not apply, you agree that any judicial proceeding shall be brought in the courts located in California, and you consent to the exclusive jurisdiction of such courts.
15.6 Apple Exception
Notwithstanding the foregoing, if you are a resident of the European Union or a jurisdiction where the above clauses are prohibited, the laws of your country of residence will apply to any dispute.
16. GENERAL PROVISIONS
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and One Habit regarding the App and supersede all prior agreements.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
16.4 Assignment
You may not assign or transfer these Terms or your account. One Habit may assign these Terms without restriction.
16.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights except as explicitly stated regarding Apple.
16.6 Force Majeure
One Habit shall not be liable for any failure to perform due to circumstances beyond our reasonable control.
16.7 Export Compliance
You agree to comply with all applicable export and import laws and regulations.
